ToS for South Africa open data portal - Open Definition compliant?

Hi all,

I came across the ToS for the South Africa Open Data portal. While the site does not mention a specific CC license it does appear to me to be compliant with the Open Definition:
http://data.gov.za/terms-of-use.html

Any thoughts on this?

By default, open data sets provided through the data portal are available for free and for use without restriction, commercial or otherwise. Where indicated, the data is governed by permissions defined by the data provider and users should consult with the provider before starting commercial projects. When using open data sets it is not necessary to credit the Department of Public Service and Administration (DPSA), Open Government Partnership South Africa (OGPSA) or the entity providing the data, however, users are encouraged to reference the data portal or the provider of the data when doing so.

Looks like the “open data sets” are open to me, though browsing around the site, it isn’t obvious which ones are governed by that default and which ones are subject to terms of another data provider.
